Article 68 ( Casual Vacancy in the Post of Vice-President and Election to Fill the Vacancy )

  1. The election of the Vice-President should be held before the expiry of the term of office of the present Vice-President.
  2. Election should be held as soon as possible to fill the vacancy caused by the death, resignation or removal of the Vice-President or any other reason. No time period has been mentioned for this in the constitution.

In this case, the Vice-President elected, under Article 67, will continue in office for five years from the date of his assumption of office.

Article 69 ( Oath or Affirmation by the Vice-President )

The Vice-President shall, before entering upon his office, make before the President or the person appointed in this behalf an oath or affirmation in the following form.

I do ................................ swear/solemnly affirm in the name of God that I will bear true faith and allegiance to the Constitution of India as by law established and to perform the duties of the office upon which I am about to enter. Will discharge with devotion.

Article 70 ( Discharge of President's Functions in Other Contingencies )

Parliament may make such provision as it thinks fit for the discharge of the functions of the President in case of any contingency not provided for in this Chapter.

Article 71 ( Subjects Related to the Election of the President or the Vice-President )

  1. All doubts and disputes arising out of or in connection with the election of the President or the Vice-President shall be inquired into and decided by the Supreme Court and its decision shall be final.
  2. If the election of any person as President or Vice-President is declared by the Supreme Court to be void, acts done by him under the powers exercised as President or Vice-President shall not be declared invalid .
  3. Any matter relating to or connected with the election of the President or the Vice-President shall be regulated by Parliament by law.
  4. At the time of election of the President or the Vice-President, the absence of any member of the Electoral College for any reason or the existence of a vacancy cannot call the election into question.

Article 72 ( Power of Pardon of the President )

The President shall have the power to grant pardons, reprieves, respites or remissions of punishment, or to suspend, remit or commute the sentence of any person convicted of an offense against the Federal Law or of a court martial.

  • Forgiveness : According to this, the punishment given to a person and all the charges against him are completely abolished and the person becomes free.
  • Commutation : According to this, the nature of the person's punishment is reduced by changing it. Like - death penalty is converted into rigorous imprisonment.
  • Avoidance : In this, without changing the nature of the sentence given to a person, its term is reduced. Like – reducing the amount of time of rigorous imprisonment etc.
  • Pause : Reducing or terminating the proceedings of the punishment given in a special situation. Like – due to physical disability or pregnancy period of women etc.
  • Procrastination : Under any circumstances, to stop the criminal from obeying the punishment given, especially in the punishment of death penalty. Its purpose is to give time to the guilty person to apologize or change the form of punishment.

Article 73 ( Extension of the Executive Power of the Union )

According to this, the executive power of the Union will extend to those subjects in respect of which the Parliament has the power to make laws and to the exercise of the right and jurisdiction exercised by the Government of India on the basis of any treaty or agreement.
